We are all in a period of uncertainty and it may be prolonged. Few trials are being listed in the Civil Courts or in Employment Tribunals and there will be inevitable delay while the courts decide how and when to list trials for hearing. Even Judicial Mediation in the Employment Tribunals is on hold at least until 29 June 2020.
Are you involved in litigation with little idea as to when you might have a trial? Are you contemplating litigation but don’t known whether or when to issue proceedings? Has the COVID-19 pandemic affected your commercial relationships with others, such as third-party suppliers or customers. Even if litigation is not your preferred course of action an early resolution is likely to be in everyone’s interests.
Does your dispute involve numerous witnesses or expert evidence? Are other matters on hold until the litigation is concluded? Does any of it have to wait until the lockdown is over?
With large numbers of employees being required to work in circumstances where they may not feel safe, more disputes may well arise. Employees being required to work from home gives rise to new problems – how are they to be managed effectively, how do you deal with apparent underperformance or indiscipline?
At Kings Chambers we have a team of mediators with a wide range of professional experience who can help you to resolve matters. There is no need to travel or to attend meetings in person, thus saving time and money. Mediations can be conducted very successfully online and at Kings we are well equipped to offer you the expertise and the facilities to do this.
While your business is on hold or merely ticking over why not use the time to clear the decks and be ready for a clean start when the pandemic is over and we can all get back to a ‘normal’ life.
