Ben will speak on the debt respite scheme and the implications of the Court of Appeal’s decision in Forbes v Interbay Funding Limited [2025] EWCA Civ 690.
Ben will break down the core components of the Debt Respite Scheme (Breathing Space Moratorium and Mental Health Crisis Moratorium) (England and Wales) regulations 2020 (SI 2020/1311), examine what is and what is not an “enforcement step”, provide practical guidance as to how a moratorium impacts common debt collection proceedings and review the Court of Appeal’s position in Forbes.
This talk will be particularly useful for those who commonly issue possession proceedings, simple debt claims, bankruptcy petitions and other enforcement proceedings (such as charge order applications and applications for possession and sale).
