Join Nick as he provides a brief recap of the principles of legal professional privilege (“LPP”), before focusing on issues of LPP following the decision in Al Sadeq v Dechert LLP [2024] 3 WLR 403. In particular, this talk will address: (1) the iniquity exception to privilege; (2) the evidential requirements for establishing litigation privilege; and (3) the scope of what constitutes “legal advice and assistance” in an investigations context and its applicability to legal advice privilege.
