Vincent Fraser QC has successfully represented RES UK and Ireland Ltd in its appeals against the refusal of Powys County Council to grant planning permission for 17 wind turbines of 126 metres in height at Garreg Lwyd Hill and the provision of a new access road. The proposal is the first to receive consent within SSA C in Wales. The appeal proposal raised particularly issues with respect to landscape and visual impact and in particular the impact upon the Shropshire Hills AONB which was approximately 3 km from the site, and the impacts upon Scheduled Ancient Monuments and listed buildings close to the proposed wind turbines. It also considered the appropriate way to address cumulative noise issues given proposals for other wind farms in the vicinity.
