Vincent Fraser QC has successfully represented Hendy Wind Farm Limited on an appeal against the refusal of planning permission for a seven turbine wind farm. The Inspector found that the proposal would give rise to significant harm to the character of the landscape and its visual amenity and cause harm to the setting of four scheduled ancient monuments.

However, Welsh Ministers noted that whilst the site was not within a Strategic Search Area it would not impact on any national landscape designation and concluded that the benefits of the proposal in terms of delivering renewable energy outweighed the impacts. The decision considered the approach to take to proposals which have a significant damaging effect on heritage assets.

A copy of the Inspector‘s case report can be found here, and the Ministers‘ decision letter here.
