Vincent Fraser QC has successfully represented Telford and Wrekin Council in an appeal against its failure to determine an application for extraction of sand and gravel and restoration of the site including land-raising at a site at Pave Lane, Newport. The appeal considered the contribution the proposal could make to the steady and adequate supply of aggregate minerals, and the contribution the proposal would make to the local and national economy. The proposal was found to conflict with the waste management strategy and the protection of best quality agricultural land, and to have potentially harmful impacts upon local amenity. The overall benefits of the scheme were found not to be sufficient to outweigh the harmful landscape and visual impacts.
