Vincent Fraser QC was successful in the Court of Appeal in the case of Menston Action Group v Bradford MDC [2016] EWCA Civ 796 which concerned the interpretation of a planning condition requiring a surface drainage scheme based on sustainable drainage principles. The case considered the meaning of sustainable drainage principles and the Court confirmed that sustainable drainage principles did not require the developer to remedy, or consider the scope for remedying, pre-existing off-site flooding problems which were not made worse by the proposal.
