Vincent Fraser QC successfully represented Newcastle City Council in a compensation claim following the compulsory purchase of a fish and chip shop as part of a regeneration scheme. The claim made in the Upper Tribunal (Lands Chamber) was for in excess of £8 million and involved numerous compensation issues including whether land was “held with” the reference property and rights to light. The claim involved multiple claimants and the factual evidence was complex and required a 9 day hearing after which the Tribunal delivered an interim decision. There was then an 11 day hearing into expert evidence which included evidence as to valuation, accountancy, disturbance, and rights to light. The Tribunal concluded that the claim was grossly exaggerated and awarded a total of £234,865 in compensation.
