Sainsburys, represented by Paul Tucker QC and Freddie Humphreys, have been granted permission to build a new retail park superstore in Southport following a called-in inquiry. The Council, represented by Vincent Fraser QC, had sought to approve the scheme, but due to its scale the scheme was called-in by the Secretary of State, where the Council continued to support the proposal. The proposal was opposed by rival supermarkets Tesco and Asda who sought to argue that the new Sainsbury’s store would undermine the town centre vitality and viability. The Secretary of State disagreed with the objectors, finding the proposal would: contribute to economic growth and generate a significant number of new jobs both during the construction phase and once the store was operational; would increase the choice and variety of the convenience offer; and would not harm existing committed or planned investment.
