The appeal was in respect of a scheme for up to 100 units on land at Mildenhall Road, Fordham, Cambridgeshire. Noise impact from neighbouring business uses had been a key element of the Council’s case at appeal. However, during Sarah’s successful cross examination, the Council’s noise witness conceded that there was, in fact, no legitimate reason to withhold consent on this basis, and the Council then formally withdrew this reason for refusal. The Inspector dismissed the remainder of the Council’s case in relation to land supply and character and appearance, and allowed the appeal.
