Sarah Clover, instructed by Cheltenham Borough has successfully resisted an Appeal by Bovis Homes and Miller Homes for a 650 homes scheme at Kidnappers Lane in Cheltenham Town.

The secretary of state acted in line with the Inspector’s recommendation that the Appeal be dismissed.

The Inspector said in his decision that, as the local development plan was out of date, and a five-year supply of deliverable housing sites had not been demonstrated by the council, the provisions of the NPPF meant that permission for the scheme would be granted unless specific national policies or a balance of considerations counted against it. The Inspector said the scheme failed both these tests and that it would impact on the transport system, prejudice potential designation of local green space and sit on a valued landscape.
