A Practical Guide to International Arbitration in the US
A Practical Guide to International Arbitration in the United States will provide a discussion and overview of the following topics:
- Legal Framework for International Arbitration (State v Federal)
- The Role of the Courts (State v Federal Law)
- Drafting an Arbitration Clause with US Seat
- Enforcing the Arbitration Agreement
- Executing on the Arbitration Award (including challenges)
This seminar, hosted by Gerard McDermott QC, will be of particular interest to those practitioners who have clients who engage in business with US organisations and/or wish to develop an understanding of the mechanics involved in the process of US arbitration.
Gerard will be joined by guest speaker Harout Samra, a leading lawyer at DLA Piper in Miami whose practice focuses on international dispute resolution and arbitration matters, including civil litigation in US courts. Harout has represented clients from both the public and private sectors, including foreign governments and clients from the insurance, banking, finance, manufacturing, aviation and hospitality industries. He has experience in international arbitrations administered under the International Chamber of Commerce (ICC), International Centre for Dispute Resolution (ICDR), United Nations Commission on International Trade Law (UNCITRAL) and International Centre for Settlement of Investment Disputes (ICSID) arbitration rules.
Sir Maurice Kay will also join the panel providing his insight and thoughts comparing jurisdictions and lead an open discussion. Sir Maurice is the Former Vice President of the Court of Appeal and accepts appointments as a senior arbitraitor for both domestic and international arbitrations.
Gerard practises from England and is based in both London and Manchester with associated offices in Abu Dhabi and New York. Appointed a Deputy High Court Judge in the Queen's Bench Division, Gerard is also a former President of the American Counsel Association and former Leader of the European Circuit of the Bar. In recognition of his long time involvement with the American Bar Association, Gerard was the first recipient of a Presidential Citation in 2015 and currently co-chairs the International Litigation Committee of the ABA.
