David Casement QC and Kelly Pennifer instructed by Marc Yaffe of JMW successfully represented Wilfried Bony, the Premier League footballer, in the appeal brought by his former agents. Bony brought a claim in the High Court against his former agents seeking multi-million pound damages for breaches of contractual and fiduciary duties.  The agents together with their companies based in the Czech Republic and the Ivory Coast challenged jurisdiction on various bases ultimately asserting that all disputes should be dealt with in arbitration under Rule K of the Football Association Rules.  In a very important decision handed down by the High Court, it was held that there was no binding arbitration agreement between the parties and the action would proceed in Court. Bony was awarded his costs of the appeal and the hearing before the district judge.
