On 14th September 2016 planning permission was granted on appeal for 275 dwellings at Sydney Road, Crewe together with a partial award of costs in favour of the Appellant’s Muller Properties Ltd. Paul G Tucker QC acted for the successful Appellants. In making the award of costs the Inspector noted: “the parallel application provided a legitimate opportunity to grant planning permission and to cut short the appeal. Thus, it is from the period following the meeting of the Strategic Planning Board, on 20 April 2016, that unreasonable behaviour has been demonstrated and that a partial award of costs for the resultant unnecessary expense incurred by the appellant is justified.”
