Paul Tucker QC and Anthony Gill, acting for Persimmon homes (Lancs) Ltd, assisted in securing planning permission for 261 new dwellings at Brindle Road, Bamber Bridge.
The site lies at the point where the M61 and M6 motorways meet. Therefore issues of residential amenity and noise propagation were central in satisfying Inspector Clegg that permission should be granted.
To achieve a successful proposal detailed design evidence was required to demonstrate that the proposal would function as a liveable community in this sensitive location.
The appeal decision follows Paul Tucker’s previous involvement in representing Persimmon as a third party on the neighbouring site at appeal in August 2018. He led an intervention in that appeal on highways matters with the same witness, Mr Devenish, appearing in this appeal. A coordinated approach to both appeals has secured this substantial permission.
