Paul Tucker QC and Killian Garvey Successfully Defend Decision to Grant 250 Holiday Lodges Near Alton Towers Theme Park

Paul Tucker QC and Killian Garvey, acting for Laver Leisure Limited, have successfully defended a decision made by Staffordshire Moorlands District Council to grant planning permission for 250 holiday lodges and leisure facilities near Alton Towers Theme Park (at Moneystone Quarry). The Council granted permission in October 2016 following a previous refusal of a similar scheme in December 2015. Moreover, on the day the Council granted permission, the Council also refused permission for a ‘no-right turn’ access at the site.

The claimant brought proceedings essentially raising allegations that the decisions were inconsistent, irrational and that inadequate reasons had been provided. HHJ Pelling QC effectively found that the decisions were not inconsistent and that, where reasons were required, they had been given. The Court also refused permission to appeal.

This represents a significant victory that has been secured after a long period of promoting the scheme against vociferous public opposition.
