Judgment was recently handed down in Metropolitan Borough Council of Sefton v Allenbuild [2022] EWHC 1443 (TCC), where Oliver McEntee successfully enforced a £2.2 million adjudication award on behalf of Sefton Council in respect of defective works at the Splash World leisure centre.

The Judge rejected the Defendant’s cross-application for a stay under section 9 of the Arbitration Act 1996.  The decision reaffirms the conventionally understood principle that absent clear provision to the contrary, the enforcement of adjudication awards is a matter for the courts.
