Nicholas Truelove, instructed by Stephen Hathaway of Scott Rees, has been successful in achieving a settlement in a complex clinical negligence brain injury case. Representing the Claimant in a matter set for a 5-day trial next month, the claim concerned a delay in diagnosis and treatment of an extradural haematoma causing brain shift with resulting psychological and neuro-cognitive impairments. Liability remained in dispute throughout, and causation was complicated by the non-negligent head injury which resulted in the haematoma. The credibility of the Claimant was put in issue by the Defendant. The matter resolved when the Claimant’s Part 36 offer was accepted by the Defendant out of time.

Nicholas was instructed from an early stage in the litigation, pre-action.

Nicholas said, “this was a great outcome for the client who sustained the injury approaching 7 years ago. The decision to take the matter to trial has been vindicated”.
