In an appeal against an enforcement notice served by the Vale of White Horse District Council which alleged the material change of use of an outbuilding to a separate dwelling Michael Rudd, representing the appellant, succeeded in having the notice quashed. In a factually difficult and sensitive case the Inspector found that there was no functional or physical separation between the main dwelling and the annex as created.
