In an appeal against an enforcement notice served by the Vale of White Horse District Council which alleged the material change of use of an outbuilding to a separate dwelling Michael Rudd, representing the appellant, succeeded in having the notice quashed.  In a factually difficult and sensitive case the Inspector found that there was no functional or physical separation between the main dwelling and the annex as created.  Michael was instructed by Ken Dijksman MRTPI of Dijksman Planning (UK) LLP.  The appeal decision can be found here.
