Michael Rudd, instructed by Paul Clisby and Loraine Adams at Warrington Borough Council successfully obtained a final injunction against the owner and occupier of land at Caddicks Nursery, Lymm, Warrington preventing the use of the land as a commercial off-site airport parking facility.
The land is located in the Green Belt and in March 2018 an application was made for planning permission to use the land for commercial off-site airport parking, for up to 1000 cars. In advance of the application being determined the use commenced. Michael Rudd obtained an ex-parte injunction against the landowner, commercial operator and persons unknown constraining the unlawful use, together with a subsequent interim injunction pending the determination of the planning application. The application was refused in August 2018 and a final injunction preventing the unlawful use, preventing the laying of hardstanding and preventing any operational development was granted in October 2018 by HHJ Sephton sitting in the Queens Bench Division of the High Court in Manchester.
