Martin Carter recently acted for Gladman Developments Limited in a planning appeal relating to land at Silver End in Braintree District. The Council had refused planning permission for numerous reasons, which included allegations of unacceptable impacts upon the landscape, listed buildings adjoining the site and the Silver End Conservation Area. The Council also alleged that Silver End did not contain sufficient services and facilities to accommodate the needs of the proposed development. It was also alleged that the development would sterilise mineral reserves under the site. 

 

The Inspector comprehensively rejected all of the Council’s arguments and granted planning permission, attaching particular weight to the benefits of the proposed market and affordable housing in an area where there was not a 5 year supply of housing.
