On Tuesday 9 May 2017, Mark Harper QC addressed the NCCBA Breakfast Seminar on the doctrine of illegality following the Supreme Court decision in Patel v Mirza [2016] UKSC 42. The talk addressed the history of the doctrine, the differences in approach between the majority and the minority in the Supreme Court and (what Mark considered to be) the difficulties in the approach of the majority by reference to recent cases that have had to apply the same.
