Andrew will provide a session titled 'Qualified One-Way Costs Shifting' and will cover the following:

  • Overview
  • Ho v Adelekun and Cartwright v Venduct
  • Chappell v Mrozek
  • Harrison v University Hospitals of Derby and Burton NHS Foundation Trust
  • McDonald v Excalibur and Keswick Groundworks
  • Getting round QOCS: Non party costs Orders and Wasted Costs
  • QOCS reforms 2023
  • QOCS: What would a Labour government do?

Gordon looks at the rules and cases to those relating to obtaining a different order as to costs if a party fails to beat a Part 36 offer, if an offer is accepted late.  He also looks at recent case law in relation to Part 36 offers made within the assessment process.

  • If you fail to beat a Part 36 offer can you escape the normal consequences?
  • If you accept a Part 36 offer late – can the court be persuaded to make a different order as to costs?
  • How relevant are Part 36 offers in relation to the costs assessment process?
