Gordon looks at the rules and cases to those relating to obtaining a different order as to costs if a party fails to beat a Part 36 offer, if an offer is accepted late.  He also looks at recent case law in relation to Part 36 offers made within the assessment process.

• If you accept a Part 36 offer late – can the court be persuaded to make a different order as to costs?
