Paul Tucker QC and Sarah Reid have successfully achieved consent for Manor Oak Homes on a site in Steeple Claydon, Buckinghamshire.

The appeal decision is notable as the Inspector was clear that unmet need in a neighbouring authority can be taken into account as a material consideration, reducing the weight given to a numerical 5 year supply demonstrated by the determining authority. The Inspector also rejected the Council’s claim that the site was Valued Landscape within the meaning of NPPF109, confirming the relevant test to be applied in light of case law and other appeal decisions.
