Killian Garvey has successfully resisted an appeal for Wellingborough Borough Council. The appeal was conducted by way of a hearing. At the outset of the hearing the appellant’s position was that the development proposal was in accordance with the Council’s development plan and that the Council could not demonstrate a five year supply of housing. As a result of Mr Garvey’s submissions, the appellant conceded that they were wrong on both points. Consequently, the Council were awarded their partial costs for the appellant having unreasonably argued the five year housing land supply point in the first instance.
