In this session of the Kings’ Young Professionals seminars, Nick Taylor (Year of call: 2019) talks about the latest position following Blu-Sky Solutions Ltd v Be Caring Ltd [2021] EWHC 2619 (Comm) in relation to onerous terms in commercial contracts. The talk will also briefly cover other ways in which contractual terms might be ‘challenged’ through UCTA 1977 and the penalty clause doctrine. With long, standard format contacts now commonplace across all areas of business this talk will be useful to all those advising on such contracts when disputes arise.
