Philip Robson, instructed by Chris May at Howes Percival, secured planning permission for 32 dwellings for Hazelton Homes in Melton Borough Council.

The key issue in the case related to technical evidence on flood risk. Philip led negotiations with the Council up to the doors of the inquiry when the Council finally withdrew their reason for refusal.  A rule 6 party continued to fight on the basis of flood risk calling a single expert witness.  In cross examination it became evident that the witnesses expertise in flooding were somewhat limited.  Ultimately the Inspector agreed with the evidence put forward by the appellant and granted the appeal.
