The High Court yesterday handed down judgment in Cheshire East Council v SOSCLG and Richborough Estates. This is an important judgment in understanding the relationship between an Inspector’s legal duty in determining a housing appeal and the scope of NPPF paragraph 49.
Anthony Crean QC has successfully advised and represented the Council on this matter and regularly acts for other local authorities on similar planning issues in the High Court.
