Killian Garvey, acting for Beechcroft Land Ltd and instructed by Hunter Page Planning, secures outline planning permission for 34 dwellings in Southbourne, Chichester.

The appeal was made in the context of:

  • the Council claiming to have a 5 year housing land supply, which was consistent with another substantial appeal decision that had been issued a few weeks prior to the inquiry;
  • the Council having a recently adopted development plan; and
  • Southbourne having a recently made neighbourhood plan.

Notwithstanding the above difficulties, the Appellants were able to demonstrate that the Council did not have a 5 year supply of housing, that the development plan was out of date and that the made neighbourhood plan should not act as a reason to refuse consent.

Furthermore, the Appellant was able to overcome local expert third party evidence concerning ecology and lay evidence concerning highways.

The appeal is most notable in its treatment of the written ministerial statement concerning made neighbourhood plans, which was found to not be a factor against consent.
