The High Court last week handed down judgment in Kelton v Wiltshire Council and ors [2015] EWHC 2853 (Admin). The case concerned an application for outline planning permission for self-build housing made on behalf of HAB Housing Limited (the development company of Kevin McCloud of Grand Designs). The court held that the decision was void for apparent bias where one of the members of the planning committee was a director of the affordable housing provider which had been identified as a prospective partner in the development and had written to the planning authority in support of the application.
