Following transfer to the Bar from the Roll, Erica has built a thriving cost practice with emphasis on costs arising from clinical negligence claims, personal injury claims and commercial litigation. Her practical, commercial awareness coupled with a down to earth and personable approach is highly valued by clients.
Erica regularly appears before Regional Cost Judges and in the SCCO. She is fast developing a busy appellant practice and is frequently instructed on appeal up to High Court level.
Whilst able to handle the full range of costs matters, she has particular specialism in the application of the various ‘Distance Selling Regulations’; ATE issues; arguments arising out of the fixed cost regimes; claims involving ‘broken retainers’; issues concerning the indemnity principle and procedural points of law. Additionally, she is retained by the NHSLA on ongoing matters involving misconduct under CPR44.11 for allegations of dishonesty within detailed assessment proceedings.
She appears in CCMCs where costs are a particular concern and where interpretation of the new budgeting regime is required.
Her non-contentious drafting and advisory work augments her contentious practice. She is developing a solicitor and own client practice.
She is a qualified Cost Lawyer and Mediator.
