Paul Tucker QC has successfully acted for McCarthy and Stone in securing planning permission on appeal, following a public inquiry for the development of a 50 unit extra care apartment block in a very sensitive part of Canterbury.

In a decision letter issued on 16th April 2020 Mme Inspector Gilbert allowed an appeal for the scheme, notwithstanding claimed heritage and townscape impacts. The Inspector concluded that despite the scheme’s location within the City of Canterbury area the strong public interest of addressing some of the City’s immediate needs for specialist accommodation for the elderly decisively outweighed the less than substantial harm that would arise. The Inspector concluded that the benefits of the scheme comprised:

‘…significant and important material considerations which indicate that development should be allowed; and thereby justify making a decision not in accordance with the development plan.’
