Paul G Tucker QC, instructed by Damien Holdstock of Turleys acted for IM Properties in the promotion of the largest ever mixed-use proposal in Stratford on Avon. The scheme in total proposed 850,000 sq ft of development (84,550sqm) and included a range of car showrooms, a large format out of centre DIY store, large scale class B employment development and even a cafe on Greenfield land to the west of Stratford.
The appeal was allowed last week after an inquiry held in November at which Gary Grant appeared for the Council and was the culmination of a lengthy process of technical work and liaison with Highways England and Warwickshire as local highway authority. The proposals were considered to be in conflict with policies in the adopted development plan but will assist in broadening the towns employment base.
Damien Holdstock observed, “this appeal demonstrates that sometimes you have to force the issue by pursuing an appeal when consultation with technical consultees becomes overly protracted”. Lewis Payne Development Director of IM properties stated: “This has been a long road to get to this position but we are delighted to have finally secured this complex consent”.
