This week the report of the Examiner of the Brighton and Hove CIL charging schedule has been published. Paul G Tucker QC was instructed by Matt Spilsbury of Turleys to act on behalf of Moda Living who were in turn promoting a large regeneration scheme at the Sackville Trading Estate. The site, which was is the largest brownfield redevelopment site in the Borough, was rated at £175 per square metre in the draft schedule; but after a spirited objection at the hearing last June – the Examiner accepted that viability had been wrongly assessed and that instead the development should be zero rated. This decision means that the scheme can now proceed bringing huge regeneration benefits to Hove, subject to the outcome of a planning appeal which is due to be heard later this year.
