Martha Garcia joined Kings Chambers as a tenant in September 2025, following the successful completion of her pupillage under the supervision of Martin Budworth and Jonathan Fletcher-Wright.
She accepts instructions across the full spectrum of Business and Property work, with a growing practice in residential and commercial property disputes, personal and corporate insolvency, and commercial litigation.
Martha’s notable successes during the practising period of her pupillage include securing interim injunctive relief in the High Court with the rare award of interim costs, and obtaining an indemnity costs order of circa £15,000 on the small claims track following a finding of unreasonable conduct under CPR 27.14(2)(g).
Before commencing pupillage, Martha worked at two global law firms within commercial real estate and construction teams, supporting landlords and developers on high-value transactions.
Martha is fluent in Spanish and welcomes instructions involving a Spanish-language element.
Commercial litigation forms the core of Martha’s practice. She has experience across a broad range of disputes, including debt recovery, sale of goods and supply of services claims and contractual construction and interpretation issues.
Martha regularly appears in small claims hearings, fast track trials, and a wide range of interim application hearings. She also has experience of interim and case management hearings on the intermediate and multi-track. During her pupillage, Martha gained particular experience advising on and acting in strike out and summary judgment applications, from inception through to final hearing.
Martha also advises and represents clients throughout the enforcement process, having successfully obtained charging orders and orders for sale against judgment debtors, and secured the return of goods wrongfully seized under a writ of control.
Martha has a broad and developing practice in property litigation. She regularly appears in possession lists, acting predominantly for landlords and mortgagees. Her advisory and drafting work spans easement and boundary disputes, claims in trespass, as well as applications for equitable accounts and orders for sale under TOLATA 1996.
Martha welcomes instructions in landlord and tenant matters, both residential and commercial. She has experience of forfeiture proceedings and has previously been successful in obtaining an interim injunction on behalf of a tenant allowing it to take back possession of its commercial premises.
Martha has experience acting in claims under the Consumer Credit Act 1974 including those relating to PPI and PCP.
Martha is regularly instructed to act for both creditors and debtors in winding up petitions. She also has experience securing bankruptcy orders, resisting applications to set aside statutory demands, and obtaining orders for sale on behalf of trustees in bankruptcy. Her insolvency practice continues to develop, with growing experience advising on and drafting applications under the Insolvency Act 1986.
