Chelsea is a commercial chancery barrister with a particular focus on insolvency, company and banking and finance litigation.

Chelsea’s practice encompasses corporate and personal insolvency, company, partnership, banking and finance, contractual disputes, guarantees, consumer claims, breach of statutory and common law duties, property, professional negligence, construction and dispute resolution.

With regular appearances in the County Court and High Court conducting trials, applications, costs and case management conferences and appeals, and an appearance in the Court of Appeal, Chelsea has a broad range of advocacy experience. She is also often instructed to attend mediations and settlement meetings on behalf of clients, and to undertake a range of advisory and drafting work. Her clients include insolvency practitioners, banks, multi-nationals, SMEs and private individuals.

Expertise

Chelsea has developed a particularly strong banking and finance practice. She regularly acts for leading commercial banks and lenders in commercial litigation and advises in relation to all manner of finance agreements and security documents and their perfection and enforcement. Chelsea’s advice often relates to issues of ownership and title, charges, personal guarantees and indemnities, contractual construction, and contractual formalities (both legal and regulatory).

Chelsea also has a strong consumer law practice and often acts for (and sometimes against) leading commercial banks and lenders in disputes with consumers and claims brought pursuant to the Consumer Credit Act 1974. Chelsea has particular expertise in dealing with claims brought pursuant to the unfair relationship jurisdiction in relation to secret commissions and unfair lending, and she regularly deals with sale of goods and services claims under the Consumer Rights Act 2015. She is often instructed to provide advice and drafting for clients in all the above areas.

Chelsea is an experienced commercial litigator with a broad practice encompassing disputes across a range of industries. Core areas of commercial work include freezing orders and other interim relief, injunctions, complex contractual disputes, guarantees and indemnities, breach of warranties, misrepresentation and deceit, restitution and enforcement of judgments.

Chelsea has a wide-ranging corporate practice. She advises and represents clients in all manner of corporate disputes, including in relation to share purchase agreements, breach of warranties, unfair prejudice petitions, shareholder disputes, derivative claims, breach of director’s duties, director’s disqualification, phoenix companies, finance and security transactions and debt recovery. Chelsea also undertakes a range of drafting, including the drafting of pleadings, applications, petitions, injunctions, witness statements, affidavits and demands.

Chelsea is a specialist insolvency barrister with substantial experience representing individuals, companies and insolvency practitioners. Chelsea advises and represents clients in all manner of personal and corporate insolvencies, including bankruptcy and individual voluntary arrangements, and administration and liquidation. She also assists insolvency practitioners in preparing and making necessary applications, including applications for possession and sale, public and private examinations, antecedent transaction and misfeasance claims, and represents directors of companies facing such claims. Chelsea deals with drafting and advisory work in all the above areas.

Alongside her company practice Chelsea often deals with partnership disputes (general partnerships and LLPs) and contentious partnership dissolutions and accounting.

Chelsea has experience of dealing with professional negligence claims involving solicitors, barristers, accountants, architects, surveyors and other construction professionals.

Chelsea is regularly instructed to advise and represent clients in a range of property disputes, including residential and commercial possession and mortgages and security. Chelsea is particularly experienced with property disputes within the insolvency sphere, with the most common claims being disputed applications for possession and sale involving issues of ownership between spouses. In addition to representing clients at court, Chelsea deals with drafting and advisory work in all the above areas.

Chelsea is a relatively new member of the technology and construction team and is building experience in relation to building safety act claims, new home builder defective works claims and residential renovation/extension disputes.
