Anthony Crean QC, instructed by Mark Chadwick at Hunter Page has successfully secured permission for 88 dwellings in the Cotswolds.

Anthony said “This decision letter is important because it is the first which explicitly takes into account the significance of the Supreme Court Judgment in Suffolk Coastal and it finds ( as many others will do ) that it is not significant at all.

The decision is also important for the way it reveals the decision making approach to a Council area which has a five year supply but does not have an up to date development plan. As paragraph 69 states: The former does not save the currency of the latter and the out of date policies attract little weight.

Finally, it confirms at para 48 that the SOSCLG’s approach, following Lichfield, is that ” Very substantial weight ” must be applied to the provision of market and affordable housing.”
