Notable Cases / Experience

Bracegirdle v All Facility Service Limited (2008) (Junior Counsel): s994 shareholder’s petition, derivative claims and personal claims involving alleged breaches of fiduciary duties, shareholder agreements and statutory obligations.

Horton v Sadler [2007] 1 AC 307 (House of Lords) (Junior Counsel): A case involving the reversal of the rule in Walkley v Precision Forgoings Ltd [1979] that a Claimant whose original claim had been struck out or discontinued could not rely upon the discretion in section 33 of the Limitation Act to disapply the limitation period when issuing a second claim out of time.

Proform Sports Management Limited v Proactive Sports Management Limited [2007]: voidability of Wayne Rooney's agreement with an agent)

Aqua Design & Play International Limited Liquidation (2005): Liquidator claim against de facto and alleged shadow directors involving wrongful trading.

Fitzgerald v Robinson (2005): breach of trust and breach of contract/fiduciary duty. The case involved tracing substantial assets through England, Scotland, Isle of Man and Cyprus.

Robin Clayton Partnership Bankruptcy (2005): Trustee in bankruptcy claim against three architects to set aside transactions defrauding creditors entered into 20 years prior to the date of bankruptcy.

Stirling Travel Insurance Liquidation (2003): Liquidator claim against a director alleged to have defrauded the company of assets immediately prior to liquidation. The case involved asset tracing and numerous transaction avoidance proceedings.
