Practice
Lisa undertakes all aspects of commercial and chancery litigation. This includes;
Company: Shareholder disputes, corporate governance, protecting minority rights, derivative actions, directors' duties, just and equitable winding-up. She recently represented two directors in a claim for breach of fiduciary duties involving a multi million pound property.
Insolvency: All aspects of administration, liquidation and receivership as well as personal insolvency
Trust litigation: Trustee's rights and obligations, asset tracing, third party liability for receipt and assistance,
Commercial litigation: contractual disputes, confidentiality, TCC disputes, arbitration, sales of goods, agency, consumer credit, asset finance and recovery, including freezing injunctions and search and seizure orders
Sports Law: the resolution of contractual disputes between participants in professional sport, Company and trusts aspects of wealth management, Disciplinary proceedings, challenging the decisions of sport regulatory bodies, breach of confidentiality and breach of privacy including urgent injunctions. I recently represented a Premiership football in Re a Debtor - a dispute between an international agent and a premiership footballer as to the entitlement to fees on a transfer.
Notable Cases
Warwick v Trustee in Bankruptcy of Clive Yarwood [2010] EWHC 2272 a successful claim for property transferred during the period between presentation of a bankruptcy petition and making of the order where it was alleged an agreement to transfer in ancillary relief proceedings had been entered into prior to presentation of the petition
Child Maintenance & Enforcement Commission v (1) Beesley (2) Whyman [2010] EWCA Civ 1344 a Test Case, on whether the Child Maintenance and Enforcement Commission was a creditor for the purposes of participating in an IVA
CEP v Steni (2009) LTL 15 October 2009 - instructed for the claimants in respect of the alleged wrongful termination of an exclusive international distribution agreement. The case raised issues as to the validity of default notices and the obligations under 'all reasonable endeavours' clauses
Shaw v API and Ferguson (2008) LTL 11 June 2008successful defence of a multimillion pound claim for alleged breach of confidentiality and fraud.
C & W Berry Limited v (1) Neil Armstrong Moakes (2) Stephanie Armstrong Moakes [2007] EWHC 2101 (QB) ,[2007] BPIR 1199 a case that was recently cited with approval in the Court of Appeal about setting aside charging orders and the effect of presentation of a bankruptcy petition on making an interim order final
Ultraframe (UK) Ltd v Fielding & Ors [2005] EWHC 1638 (Ch) - leading case on directors duties and corporate fraud.
