Profile:

Emily became a tenant at Kings Chambers in the autumn of 2006 after successful completion of pupillage. She practises in all aspects of Chancery and commercial litigation. Emily regularly appears in the County Court and High Court representing clients  nationwide ranging from individuals to large institutions.

Real Property:

Emily has a keen interest in property law and her practice spans all areas of real property including interests in land, boundaries and rights of way, rights to light, proprietary estoppel and adverse possession, residential and commercial landlord and tenant disputes and land registration issues arising out of mortgage fraud and lender error. She has appeared before the Adjudicator  to HM Land Registry and has acted for commercial clients, private individuals and local authorities in this field.

Insolvency:

Emily's practice encompasses both personal and corporate insolvency. She has considerable experience of winding up petitions, bankruptcy proceedings and applications arising out of the administration and liquidation of companies. Recent work includes acting for a lender challenging a company's choice of administrator in the High Court and advising in relation to section 216 of the Insolvency Act.

Banking:

Emily regularly undertakes work for and against lenders in relation to secured and unsecured lending (including mortgages and guarantees) and finance litigation. She has experience of mortgage shortfall claims, litigation arising out of mortgage fraud and Consumer Credit Act issues arising in mortgage possession claims.

Finance:

Emily undertakes work in banking, finance and consumer credit. She has experience of acting for lenders providing lease finance and has recently been instructed in relation to a number of PPI mis-selling claims.

Professional Negligence:

Emily's experience encompasses professional negligence claims with a land-related element against solicitors and surveyors and claims against financial advisors.

Partnership and LLPs:

Emily has experience of partnership disputes in relation to professional practices such as solicitors and medical practitioners.

Trusts and Probate:

Emily has experience in dealing with disputes arising out of wills and Inheritance Act claims and is keen to develop her practice in this area.

Dispute Resolution:

Emily undertakes advisory and advocacy work in connection with a wide range of commercial and chancery disputes including contracts, torts, supply of goods and services, real property, trusts, insolvency, mortgage litigation, consumer credit, enforcement of judgments and all procedural aspects of the CPR. Emily is happy to appear at mediations.
