Local authority decision on services for autistic child declared unlawful by High Court

9th August 2011

This case concerned the provision of services for an autistic child who lived at home with his parents and sister. He was diagnosed with autism and ADHD and displays challenging behaviour which his family are struggling to cope with. The child was assessed as needing particular services but was unable to access them. No services for autism were provided by the authority within its borders. Despite the parents requests to the authority to ensure that their child got the services he needed the case was closed. The High Court quashed the authority's decision and ordered them to carry out a reassessment of need according to their statutory duties.
