Judgement secured for infant claimant in road traffic accident

Michael Rawlinson QC has recently secured judgment for an infant Claimant, who suffered a catastrophic combination of spinal, brain and lower limb injuries, in the Leeds High Court in a stoutly defended road traffic accident claim brought against the MOD. 

The case centred around the devastating head, spinal and leg injuries inflicted by the military driver of a 4 ton lorry.

The interest in the case lies in the fact that liability was secured notwithstanding that the Defendant was travelling as little as 15 mph at the time the Claimant first ran onto the road ahead of him, with the Court adopting the line of reasoning contained in D v Toropdar. The Court will now go on to determine the appropriate level of quantum.
