High Court Injunction against Unite

30th November 2011
Colin Bourne and Ben Williams have succeeded in obtaining an injunction against Unite the Union, restraining them from calling out on strike employees of a Bus company in Warrington. The strike was part of the national strike called by a number of public sector unions in relation to Government proposals to make changes to public sector pensions.
Employees of Warrington Borough Transport were balloted to join the strike. Only 39 out of over 180 staff returned ballot papers with 25 voting in favour of the strike and 14 against. When the Company discovered that a number of staff who should have been included in the ballot had not received ballot papers, Colin Bourne, leading Ben Williams, applied for and obtained an injunction preventing Unite calling on its members to strike.
