Dr M v United Lincolnshire Hospital Trust
Colin Bourne successfully defended a claim brought by a Consultant Physician in which he alleged that he had been discriminated against because of his visual impairment, that the Trust had failed to make adjustments for his disability and had dismissed him unfairly.
The Claimant had suffered from loss of sight as a result of taking a cocktail of drugs to treat cryptic milliary tuberculosis. The Trust would not allow him to work as a Consultant physician because he was unable to carry out a visual examination of patients. The Claimant argued that he should have been given a range of other duties such as education, training and administrative work to allow him to continue to be employed as a Consultant Physician.
