Military Claims & inquests
For many years those members who practised in this area, were also members of the Attorney General’s panel of Civil Counsel and regularly acted on behalf of the MOD in claims brought by members of the Armed Forces. Whilst some are still engaged in defending claims as diverse as helicopter crashes, military medical negligence and non-freezing cold injury, the vast work of this sub group is now provided by instruction on behalf of Claimants and the families of the fatally injured service personnel.
Members have been involved in high profile inquests such as the ‘Nimrod’ and ‘Snatch Land Rover’ inquests (both of which led to parliamentary questions to the Prime Minister of the day), appeals against scheme awards following injury and claims of all values arising out of military life. Our members have, of course, a high level of technical competence (in respect of the both the substantive law – such as combat immunity and in respect of procedure including the various Pension and Injury Benefit schemes). However, the main emphasis is placed on understanding the reality of military life for both the participants and their families and how those realities are best to be reflected within the litigation process.
