Disease & Toxic Exposure

 

Members of the Disease & Toxic Exposure team have extensive experience in the well recognised categories of disease litigation such as asbestos related conditions, NIHL, HAVS, dermatitis and non-asbestos respiratory disease.

Of equal importance is their familiarity with ‘non standard’ exposure claims such as thyroid cancer said to arise from medical exposure to X Rays; leukaemia from exposure to fuel vapours and ethmoid adenocarcenoma from wood dust. Particularly with regard to asbestos work members of this team have been instructed in some of the highest profile cases of the last ten years including Fairchild v Glenhaven and Grieves v Everard (The Pleural Plaques test litigation). Of course, technical competence is an absolute given for all members of our team but this is allied to an understanding that many of the concepts which are forged in this area of litigation (such as causation) can be applied in the non-disease litigation sphere to the distinct advantage of the party deploying the same.

Whilst there is an even split between Claimant and Defendant work, where members are instructed by Claimants, a positive attitude is taken to CFAs and the risks inherent in cases with such funding.

Members regularly provide talks and training to insurers and solicitors both as to the detail of litigation practice and the more theoretical direction of legal development.
