Byelaws and orders

The public law section of Chambers deals not only with the usual sources of law emanating from central government through primary and delegated legislation, but also has particular expertise in relation to local sources. Indeed, with increasing recognition of the different needs of localities, there has been a resurgence of interest in tailoring the law to suit local conditions though these devices.

This can take the form of seeking to interpret existing instruments, sometimes made many years ago, to deal with new developments or changes in standards expected by the public. It can also take the form of enacting new byelaws or orders to make specific provision for new activities, for example regulating the use of jet skis, curbing anti-social behaviour or seeking environmental improvements through regulating activities in certain areas.

Whatever the issue the members of the team can assist in the drafting, interpretation and enforcement of byelaws and orders, ensuring that worthwhile aims do not fall foul of the principles applied  the courts.
