Costs of commercial disputes

Commercial disputes are often bedevilled by tactical game playing and brinksmanship. The more senior members of the costs team have seen it all before dozens of times, and are able to give advice accordingly. Prof McGee has the additional advantage of having a commercial practice in addition to a costs practice.

A team approach is usually best, and it is often cost effective for that team to include a (senior) costs draftsman.

Commercial disputes often require an immediate response from counsel, so it may be good idea to make sure that counsel is going to available generally rather than merely for the hearing or conference in question.
