Conduct and misconduct

This topic ranges from arguments about proportionality, all the way through to arguments under the CPR rule 44.14. These are issues which are particularly fact-sensitive, and as such, it is often best to instruct counsel with particular expertise in witness handling and making submissions based on live evidence; Paul Hughes, Matthew Smith and Craig Ralph will fall into that category. If the point turns on the law (as can often be the case), then Mark Friston and Craig Ralph would be suitable, not least because they were involved in a recent leading case on the topic of conduct (Drew v Whitbread).
